SCRIPT
If you die without a will, your estate is distributed according to your state's intestate succession laws. And the state's plan almost certainly does not match what you would have chosen.
In most states, if you are married with children, your estate splits between your spouse and your children in proportions the state defines, not you. In some states your spouse might receive only one third. Your children, including minors, receive the rest.
If a minor child inherits directly, the court appoints a guardian of the property to manage it until the child turns 18. At 18 they receive the full amount with no conditions. Most parents would not have chosen that structure.
If you are unmarried with no children and no will, your assets typically go to your parents. If your parents are deceased, they go to your siblings. If you have a long-term partner who is not a spouse, they may receive nothing.
A will is not complicated or expensive to create. It does not require a complex estate. It requires knowing what you want and writing it down legally. Dying without one hands that decision to a formula that was not designed with your family in mind.
