Most people who have a will think their estate is covered. It is not, because of one thing they almost certainly never updated: their beneficiary designations.

Your 401(k), your IRA, your life insurance, they all transfer to whoever is named on a form you filled out when you first opened the account. That form overrides your will completely. Legally. Permanently.

So if you named your ex-spouse in 2009 and you never changed it, your ex-spouse gets the account. Your will says something different? Irrelevant. The beneficiary form wins every single time.
