The number one cause of family conflict after a parent dies is not how much money there is. It is the absence of clear instructions about who gets what and why.

When parents leave assets equally to multiple children without specifying how the division works, the practical problems start immediately. One child wants to sell the vacation home. One wants to keep it. One cannot afford their share of the property taxes. Without a plan for how to handle those scenarios, the legal structure creates a family dispute.

The fix is specificity. Name who gets what, in writing, with the reasoning behind it. If one child is receiving less because they already received significant gifts during your lifetime, explaining that in your plan prevents confusion and resentment.

If you have a business, a vacation property, or any asset that cannot simply be split down the middle, your estate plan needs explicit instructions for how that asset is handled.

This is not a legal conversation, it is a family conversation. And the best time to have it is while you are alive and can explain your thinking yourself.
