SCRIPT
Most people have an estate plan that says one thing and retirement accounts that say something different. That conflict costs families money and sometimes causes the wrong people to inherit.
Your estate plan might direct assets equally to your three children. But if your IRA beneficiary form only names two of them, or if it names an old trust that has since been superseded, the IRA does not follow your estate plan. It follows the form.
Your estate plan might be designed to minimize estate taxes by directing assets into a credit shelter trust at death. But if your IRA names your spouse outright as beneficiary, the IRA bypasses that trust entirely.
Your estate plan might account for a child with special needs by creating a special needs trust. But if that child is named directly as a beneficiary on a retirement account, the inherited account could disqualify them from government benefits they depend on.
The fix is a coordination review. Your beneficiary designations on every retirement account and life insurance policy need to be looked at in the context of your overall estate plan, not in isolation. They are part of the same document, even if they live in different places.
