When one spouse needs nursing home care and the couple turns to Medicaid for help, there is a common fear that the healthy spouse at home will be left with nothing. That fear is partly founded but also overstated, because federal law has specific protections for what is called the community spouse.

The community spouse, the one still living at home, is allowed to keep a minimum monthly maintenance needs allowance from the nursing home spouse's income to cover living expenses. In 2025, that floor is approximately $2,555 per month.

The community spouse also keeps what is called the community spouse resource allowance, a portion of the couple's combined countable assets. The exact amount varies by state but ranges from approximately $30,000 to $154,000 in 2025.

The primary home is generally exempt from Medicaid asset calculations while the community spouse is living in it. It is not taken from them during their lifetime.

These protections exist precisely because the law recognizes that impoverishing one spouse to pay for the other's care is not the intent of the program. But the rules are complex and state-specific.
