SCRIPT

When you create a will, you name an executor. That is the person responsible for managing your estate after you die. They file paperwork with the court, gather and value your assets, pay your debts, file your final tax return, and distribute what remains to your heirs.

Most people name a spouse or an adult child without thinking carefully about whether that person is actually equipped to handle a significant administrative and financial responsibility during what will be one of the most difficult periods of their life.

The executor role can take hundreds of hours over one to two years. It requires organized record-keeping, communication with courts and financial institutions, and the ability to make impartial decisions that may affect family members who all have their own opinions.

Naming a co-executor sounds like a compromise. In practice it often creates conflict, because both people need to agree on everything and they frequently do not.

Think carefully about who in your life has the organizational capacity, the emotional stability, and the geographic availability to do this job well. You can also name a professional executor, a bank trust department or attorney, particularly for larger or more complex estates.

This is one of the most important decisions in your estate plan and it is often made in 30 seconds. It deserves more than that.

PRODUCTION NOTES

Serious, practical. This is a genuinely useful consideration most people have never thought about. Warm, not alarming.
